Understanding Class Action proceedings in Australia

In Australia, Class Action proceedings, also known as representative proceedings, begin when a group of seven or more people combine to seek damages for similar occurrences against the same party. This can occur at both State and Federal Court levels, depending on the nature of the matter.

Class members are generally represented by a single class representative, who represents the interests of the Class Members. This person becomes known as the applicant.

Shareholder, or Securities Class Action cases, are less common but have risen over the last two decades. These proceedings are related to prohibitions on misleading and deceptive conduct, and continuous disclosure in the financial investment sector.
